The Anatomy of Hiring and Firing - Examining Real Employment Decisions

Join us in person on Thursday, August 17th, as we work through employment decisions faced by employers. We will discuss each decision that lead the employer down the path towards litigation and analyze where they went right … or wrong.

Situations that we will review include:

Poor employee review due to traits that might be associated with autism.

Employee “nick-names” such as “half-dead Dave” and “work mom.”
Inquiring about plans involving having children or returning from maternity leave.
Offering an employee improvement plan to an employee, after the supervisor said she “just wants to divorce” the employee.

Hiring an employee into an entry level position if the employee has a master's degree and five plus years of experience.
Maintaining hiring requirements that involve gender as a bona fide occupational qualification.

The Pregnant Workers Fairness Act (PWFA) changed the landscape for employers and employees. This law now requires an employer to reasonably accommodate employees who experience pregnancy-related complications. Following on the heels of this law, the EEOC has issued proposed regulations to support and achieve the purpose of the PWFA. These regulations include features that may surprise some employers – including the temporary suspension of essential job functions, greater enforcement of lactation requirements and covering issues related to abortion, menstruation, and miscarriage. As we go into an election year, various Federal agencies are making the push to implement certain long-standing items on their regulatory agendas. The U.S. Department of Labor (DOL) is looking to continue to strengthen its position that most workers are employees and not independent contractors. To this end, the DOL is proposing streamlined regulations to “test” whether a worker is an employee or an independent contractor. Similarly, the DOL is working to implement the Pregnant Workers Fairness Act. The Federal Trade Commission is working to eliminate most noncompete agreements by regulatory mandate. While the Equal Employment Opportunity Commission (EEOC) is looking to strengthen its position with respect to recruiting and AI and potential discriminatory implications involving this new technology. Simultaneously, the EEOC continues its enforcement initiatives involving underserved communities and potential barriers to the advancement of certain protected classes.
