A few months ago, we wrote about the changes coming to how and when you’re company needs to file its EEO-1 report. The Equal Employment Opportunity Commission (EEOC) handed down these guidelines earlier this year. While your Component 1 data filings were due May 31st, the EEOC has extended the deadline to ensure your company has ample time to compile and file its report. Whether or not you need to submit a report depends on your company size and the nature of your business.
When is the EEO-1 Report Due?
As mentioned above, you should have filed your previous year’s data on May 31st, 2019. The EEO-1 report is due September 30, 2019. That’s this month, so make sure you’re prepared.
This is a new requirement from the EEOC and comes as a result of a lengthy court battle. While the Department of Justice is appealing the decision, it did not stay the court order for filing. The determination was that companies must now submit Component 2 data to supplement the Component 1 reports due earlier this year.
What comprises Component 2 data? On top of the basic demographic information found in Component 1 data, Component 2 data is more about the actual work and when it’s done. Information including pay found W-2’s and hours worked will all need to be collected, reported and filed by the September 30th deadline.
Do I Need to File an EEO-1?
In broad terms, you only need to file an EEO-1 if your company employs over 100 people. This rule excludes public schools, colleges and universities as well as private membership organizations. Furthermore, certain federal contractors who employ over 50 people may also be required to file the EEO-1 if they meet certain criteria.
Again, if your organization employs fewer than 100 people, you do not need to file the EEO-1 Component 2 data by the end of this month. For more on these guidelines, click here.
