The Pregnant Workers Fairness Act (PWFA) changed the landscape for employers and employees. This law now requires an employer to reasonably accommodate employees who experience pregnancy-related complications. Following on the heels of this law, the EEOC has issued proposed regulations to support and achieve the purpose of the PWFA. These regulations include features that may surprise some employers – including the temporary suspension of essential job functions, greater enforcement of lactation requirements and covering issues related to abortion, menstruation, and miscarriage.
